Please read these Terms of Service carefully before using the Nexagent Automation platform. These terms constitute a legally binding agreement between you and Nexagent Automation.
Acceptance of Terms
By accessing or using the Nexagent platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services. We may modify these terms at any time, and continued use constitutes acceptance of the updated terms.
Description of Services
Nexagent provides AI-powered receptionist and business automation services, including but not limited to call handling, appointment request management, customer identification, and workflow automation. All appointment requests submitted through our AI are subject to human review and confirmation before any commitment is made.
Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
Acceptable Use
You agree not to use the service for any unlawful purpose, to transmit any material that is abusive, harassing, fraudulent, or otherwise objectionable, to interfere with or disrupt the integrity or performance of the service, or to attempt to gain unauthorised access to any part of the service or related systems.
Telephony Compliance
When using our AI receptionist service, you are solely responsible for ensuring compliance with all applicable telephony laws and regulations in your jurisdiction, including call recording consent laws. You must inform callers of any AI or recording in accordance with local requirements.
Payment and Billing
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to modify our pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.
Intellectual Property
Nexagent and its licensors retain all intellectual property rights in the platform, including software, documentation, and branding. You retain ownership of your own data and content. You grant us a limited licence to process your data as necessary to provide the service.
Limitation of Liability
To the maximum extent permitted by law, Nexagent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the service. Our total liability to you for any claims arising out of these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
Termination
Either party may terminate this agreement at any time. Upon termination, your access to the service will cease. We will retain your data for 30 days following termination, after which it will be permanently deleted unless you request an earlier deletion.
Governing Law
These terms are governed by the laws of the jurisdiction in which Nexagent is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
